Our Debt Recovery Team is headed up by Deborah Hooton, an experienced solicitor with another solicitor, Amy Platt and a paralegal, Helen Sutherland, managing all the work.
We will always offer an initial and free assessment of the best and most cost effective way of collecting a business debt. Our aim is to give best advice on the method of debt collection for unpaid invoices.
We do not offer a volume recovery operation for large numbers of debts. Our service is tailored to the needs of businesses. We review the position with our clients on the debts, consider the ability of the debtor to pay the debt, and then advise on the best method to maximise recovery.
In some cases, it may be appropriate to issue proceedings in the High Court or County Court to seek a judgment which can then be enforced against the debtor.
In other cases, we may advise that as the debt appears to be incapable of being disputed that the most likely method of achieving payment is to take action via what is known as the insolvency route.
In the case of an individual debtor, then it would be necessary to serve a Statutory Demand and if this is not complied with then to issue a Bankruptcy Petition at court.
In the case of a debtor company then while we would advise in some cases that a Statutory Demand be served in the first instance, there will be many cases where we will advise the debt should be pursued by the issue of a Winding Up Petition at court without the need for service of a Statutory Demand on the debtor company.
